Historical aspects of the modernization of German legislation on the social integration of persons with disabilities

Abstract

The main indicator of the development of any socially oriented state is not only the economic well-being of the population, but also the public attitude towards socially vulnerable categories of citizens, including persons with disabilities. At various stages of the formation of Germany as a socially oriented state, the attitude towards persons with disabilities and their families changed from complete alienation to the creation of an inclusive society, which was reflected in legislation.

The purpose of the article is to analyze the historical prerequisites for the formation of modern legislation regarding the integration of persons with disabilities into social and political life and the construction of a modern inclusive society in Germany.

The scientific novelty consists in elucidating the theoretical and methodological foundations of the German state policy regarding the social integration of persons with disabilities through the analysis of scientific sources; study of the peculiarities of state policy regarding the social integration of this category of citizens based on a retrospective analysis of German legislation; generalization of the positive experience of Germany in relation to the state policy on the social integration of persons with disabilities.

The methodological basis of the research is a combination of general scientific, special and philosophical methods, such as: formal-logical (the essence and features of the German state policy regarding the social integration of persons with disabilities are analyzed); historical and legal (the issue of formation and development of legislation on the rights of disabled people is clarified); formal and legal (norms of German legislation are analyzed); statistical (the information regarding purpose of the research is studied, analyzed and summarized); analytical (the essence, state and problems of German state policy regarding persons with disabilities are identified); synthesis (organizational and legal principles of management activities regarding the social integration of persons with disabilities in Germany are identified), etc.

Conclusion. A set of joint measures was taken in Germany to ensure the implementation of practical actions, both on the part of state authorities, legislative and executive, and on the part of public institutions, with the aim of improving the regulatory and legal basis for promoting the social integration of persons with disabilities, expanding their rights and opportunities for participation in the life of the community, in discussing issues and making decisions at all levels, improving public attitudes towards persons with disabilities, ensuring their employment and career development.
