Military constitutionalism: on the question of the formation, understanding and design of phenomenology

Abstract

General constitutionalism acts as an objective factor of democratic legal statehood and should ensure the existence of a human-centered political and legal system in which fundamental human rights have priority in relation to the state. Such a transposition and construction of priorities and sequence of rights not only limits the state power in its tendency to statism and arbitrariness, but also establishes clear normative limits of its functioning - and the most important guarantee of the existence of such a system is the state constitution, which, on the one hand, recognizes and legalizes , protects, protects, guarantees fundamental human rights, on the other hand – clearly establishes legal restrictions for the state, its bodies, officials and officials.

Unfortunately, in modern conditions, the state of international peace and international security, and with them the entire system of international law and order, are under threat, thanks to the aggressive armed attack of the Russian Federation on Ukraine, which poses, objectifies and actualizes the question of the formation of military constitutionalism, as one of the types general constitutionalism, and in the context of its multi-level understanding – starting from the local, then regional, national, macro-regional, and ending with the global level, which will find its place in the phenomenology of global constitutionalism.

The purpose of the article: to summarize and investigate the evolution of the formation of the phenomenology of military constitutionalism in the context of an objective factor that strategically affects the protection of international peace and international security of states and their international community.

The scientific novelty consists in identifying trends that contribute to the formation within the general constitutionalism of its military specific form (variety); systematic analysis of doctrinal approaches aimed at the formation of constitutional and legal mechanisms regarding the exercise of public power in conditions of extraordinary functioning of statehood; determination of the subject-object composition of military constitutionalism.

The research methodology consists of a system of philosophical, general scientific, special-legal methods, in particular dialectical, formal-logical, historical, logical-semantic, structural-functional, systemic, sociological-legal, hermeneutic, comparative legal methods, methods of analysis and synthesis, and others.

Conclusions. It is proved that the doctrinal development of military constitutionalism in the modern science of national constitutional law continues in several directions:

  1. a) through the development and deepening of research on the formation of new and improvement of already doctrinally recognized elements of general constitutionalism;
  2. b) through the study of topical issues of the functioning of constitutionalism in extreme conditions through the prism of the ratio of establishing (legitimate) and established (actual) power in crisis periods;
  3. c) through the study of the functioning of the phenomenology of constitutionalism in a more specific aspect - the state of war;
  4. d) due to the functioning of the phenomenology of constitutionalism due to the phenomenon of municipalism - the existence and functioning of territorial human communities in the relevant territory in the conditions of local self-government in the state of ordinary or extraordinary functioning of statehood - but they testify to the objectification and actualization of the need for doctrinal justification and progress towards the formation of a constitutional martial law

Evidence of the relevance and possibility of the formation of the phenomenology of military constitutionalism in the modern science of national constitutional law are intensive processes of formation at the national and international levels of the phenomenology of ecological constitutionalism, as one of the types of general constitutionalism – the national constitution-makers and the structures of a single international universal intergovernmental organization take an active part in these processes – UN at the level of national and international norm design and norm-making; national and international judicial bodies in the process of considering cases of a specialized nature; different levels of public power operating on the territory of an independent state, including local self-government bodies acting as bodies of public self-governing (municipal) power and acting on behalf of territorial communities and in their interests; various subjects of the institutional structure of civil society, including international and national non-governmental organizations, etc., i.e., an appropriate behavioral-activity and management-functional paradigm based on international and national normative arrays is created.

Borrowing the above approach to the formation of military constitutionalism will be useful not only for states in the context of preparing their constitutional legislation and constitutional legal practice for actions in the event of extraordinary conditions for the functioning of statehood in the specialized sphere, but also for the international community and its member states, and , both in doctrinal and praxeological aspects, taking into account its high constitutional and axiological potential and significance for the existence and further functioning of human civilization and its state-legal and international legal support.
