Development of legal and institutional framework of the Kosovo Specialist Chambers and Specialist Prosecutor’s Office

Abstract

The purpose of the article is to study the development of the legal and institutional framework for the establishment and activity of the Specialist Judiial Chambers and the Specialized Prosecutor's Office for Kosovo (Kosovo Specialized Court) to investigate war crimes, crimes against humanity and other international crimes committed in Kosovo and Albania, which occupies a special place in the system of international criminal justice in view of the specific features of its formation and activity, the formation of its international and national components.

The scientific novelty is a comprehensive study of the development of the legal and institutional framework of the Specialized Court for Kosovo, established by the European Union to bring to justice the «winners» – former leaders of the so-called «Kosovo Liberation Army» («UÇK»), who never convicted during the activities of the International Criminal Tribunal for the Former Yugoslavia (ICTY) for war crimes, crimes against humanity and other international crimes in Kosovo.

Conclusions. The Specialized Court for Kosovo, located outside Kosovo in the Hague (Netherlands) and with the exclusive participation of international judges and prosecutors, is an important form of international criminal justice. As the legal basis of this Specialized Court is fully in line with international law, this Court is an international criminal body, although formally part of the judicial system of the Republic of Kosovo, whose international legal status needs to be resolved.

This Court, in the formation of the legal and institutional framework of which the UN, the Council of Europe, NATO, the European Union and individual states, as well as the Republic of Kosovo have participated, is not only an internationalized criminal court with a complex legal landscape, but also one of the necessary to achieve justice in Kosovo.

As the International Criminal Tribunal for the former Yugoslavia has completed its jurisdiction and the Specialized Court of Kosovo is having difficulty, the history of prosecuting individuals for international crimes in Kosovo and Albania, regardless of the status of the perpetrators, is far from over. The assessment of the Kosovo Specialized Court appears to depend on its ability to prosecute and punish all perpetrators of international crimes in Kosovo and Albania, which will provide a sense of justice, especially for victims, and a sense of the rule of law.
