Decentralization of powers of public authority and its influence on local government in the context of modernization of individual and collective human habit

Abstract

The article is devoted to the study of topical issues of the impact of decentralization of public authority on local self-government in the context of modernization of individual and collective human habit.

The aim of the article is to study theoretical and praxeological approaches to determining the impact of the phenomenology of decentralization of public authority on local self-government in the context of modernization of individual and collective human habit.

The scientific novelty of the study lies in the doctrinal-theoretical and practical consideration of approaches to determining the indirect impact of the phenomenology of decentralization of public authority on local government in the context of modernization of individual and collective human habit

Conclusions. The article defines that the processes of decentralization of powers of public authorities: aimed at the formation of real and optimal legal personality of TG, the formation of real-functional and competency-based EOM, significantly contribute to the transformation of constitutional and municipal legal status. local society, operating in a local democracy in the direction of its expansion and improvement, in fact, modernizing the individual and collective habit of man, arising from the expansion of its forms of life within the TG in everyday life and the accumulation of practical knowledge, skills and abilities in the process application and implementation of the latter, including the relevant existential-praxeological discourse of existence and functioning in the territorial human community.

It is proved that the phenomenology of decentralization of public power, more precisely in operational understanding and implementation – decentralization of public authority – as a management-efficient, functionally efficient, technological and logistical mechanism of public authority in a democratic state governed by the rule of law, is characterized by the following factors: a) it is implemented in the process of carrying out constitutional reform by the state, aimed at achieving the relevant teleological dominants (transformation criterion); b) by transfer (redistribution) of power (rights and responsibilities, organizational, regulatory, material, intellectual and other resources) from central authorities to local public authorities, primarily public self-government (municipal) government, ie "from above – down "(technological resource criterion); c) within the limits established by law (regulatory and legal criteria); d) due to the corresponding expansion of the competence base of the subject of public authority-addressee and, accordingly, narrowing of the competence base of the subject of public authority-addressee (competence-dynamic criterion); d’) with the transfer of appropriate resource (material and financial) support for each relevant authority (competence-resource criterion); e) that will ensure a high level of independence of the subjects (beneficiaries) of decentralization, the possibility of their functioning within an expanded competent base at its discretion and under its responsibility, with limited excessive control over their activities by the state (activity-discretionary criterion); f) taking into account the need for effective interaction between these levels of public authority and civil society institutions (collaboration criterion).

In the formation of human habit, we are talking primarily about: the formation of behavioral guidelines that arise during the functioning of man within the territorial community, in local government, in everyday life, in solving existential issues of its existence and functioning, in the process implementation of its life cycle – it all happens through the realization of human rights, freedoms and responsibilities, which together constitute the constitutional and legal status of man (individual), and at the local level of society are qualified by representatives of municipal law doctrine as municipal rights person (individual, member of the territorial community), which are implemented with the help of local governments, through the use of their competencies.
