Regime of the state of emergency of during an of infectious disease pandemic: mechanism of legal regulation as a guarantee of adherence the principle of the rule of law

Abstract

The introduction of emergency regimes, and in particular the regime of state of emergency, is always accompanied by restrictions on human rights and freedoms. The scope and depth of such restrictions directly depend on the severity of man-made or natural emergencies and on the decisions which taken by public authorities. An integral condition for the introduction and administration of emergency regimes - must be adherence to the rule of law.

The purpose of the articleis to analyze the rules of national law governing legal relations arising in connection with the introduction of emergency administrative and legal regimes, including the regime of state of emergency during a pandemic and determine of the legal mechanism that guarantees observance of the rule of law in relations between state and a human.

Scientific novelty of the research is to analyze the norms of national legislation for the existence of fuses limit the discretion of public authorities and, able to provide observance the rule of law in the relationship between the state and the human in case of introduction of the regime of the state of emergency during a pandemic of the infectious disease COVID-19.

Conclusions. Analysis of national legislation governing legal relations arising during the introduction of emergency regimes, in particular, the regime of state of emergency, shows about the presence in the mechanism of legal regulation fuses that in some way limit the discretion of the subject of power (of the President of Ukraine), including : 1) establishment of the specific term for which the regime of state of emergencycan be introduced and extended; 2) in a certain way (albeit formally) the powers of the President of Ukraine to determine the list and depth of restrictions on the rights and freedoms of citizens during the introduction of the regime of state of emergency are limited by law; 3) in accordance with the norms of the special law, a separate branch of power (legislative power) is empowered to approve decisions of the President of Ukraine on the introduction and continuation of the regime of state of emergency.

This allows the Parliament to control the expediency and validity of the decisions of the President of Ukraine on: the introduction and continuation of emergency regimes, as well as the list, scope and depth of restrictions on the rights and freedoms of human proposed for application (in terms of compliance of the severity of the emergency situation in connection with the occurrence of which, the regime of state of emergency is introduced).

The above fuses constitute a legal mechanism for the implementation of the principle of the rule of law and, accordingly, are a guarantee of abidance for human rights and freedoms in the event of the regime of state of emergency.
