Communicative and communication policy in the context of the reintegration of the temporary occupied territories of Ukraine

Abstract

In the domestic science of labor law, studies of the subject of legal regulation give some idea of the ontological aspects of the brunch, but do not form a clear concept of reform of Labor Law and theories on the basis of which it should take place. The social purpose of Labor Law must be strengthened through the development of concepts of collective labor relations and the system of individual labor relations.

The purpose of the article is to outline the ideas of updating the basic doctrine of Labor Law and to identify, on their basis, the directions of development of Labor legislation.

Scientific novelty. The dialectical connection is the basis for the recognition of collective Labor rights as a legal mechanism for the protection of individual interests in the field of labor. The realization of rights that contain socio-economic guarantees for employees, other than the state minimum, should be ensured only through the mechanisms of social dialogue (partnership). Legal norms providing for such rights must be enshrined in collective labor law.The mechanism of their provision in individual Labor Law, in the absence of a collective agreement - is established by agreement of the parties to the labor contract.

The possibility of a balanced combination of methods of legal and non-legal influence on labor relations requires the recognition of the labor agreement as a source of Labor Law.

The progressive expansion of the norms of Civil Law on relations, the subject of which is professional work, requires updating the concept and features of labor relations. Within the concept of the system of labor relations, this notion can be generalized, and its features can vary depending on the type of labor agreement. In this aspect, we consider it appropriate to understand individual labor relations as social relations regulated by Labor Law, the subject of which is not self-organized and paid work performed by the employee personally with using, as a rule, professional skills.

Permanent labor agreement and labor relationships arising from it should remain a priority, but at the expense of tax and social security legislation.

Conclusions. The monopoly of any legal ideas and concepts becomes undesirable if it can no longer be applied without radical changes and does not ensure the role of law in solving practical problems and in determining areas for further legal development. Without updating the paradigm of the brunch of Labor Law, which would be recognized by the vast majority of scholars and, accordingly, would receive the status of doctrinal, it is impossible to complete the process of new codification of Labor Law.

The gradual adoption of the new Labor Code, the structure of which will include Book I «Individual Labor Law» and Book II «Collective Labor Law», is the best way to codify.
