Legal regulation of media activities in Hungary of the present stage

Abstract

The purpose of the article is to analyze the legal regulation of the Hungarian media after the change of the political system in the country in 1990, to determine, based on the analysis, some features of this process inherent in this country.

The scientific novelty is determined by the study of the impact of legal regulation on the evolution of the Hungarian media system and the assessment of the international community's compliance with the democratic principles of the new media legislation of this country.

Conclusions. In the process of formation and development of the information society there is an urgent need to improve the functioning of various mass media and their legal regulation. The formation of a modern institutional media system in Hungary began in 1996 with the adoption of the Law on Mass Media, which introduced the basic structure of the media, typical of most European countries, including state, commercial radio and television. The law established the basic principles of the media, obliging them to provide universal, factual, timely, objective and balanced information, as well as not to reflect the views of a particular party or political movement. However, the Media Law did not lead to a freer, more independent press, as it became a field for political games. Governments changed, but the media, which were declared independent by law, became part of the political booty of the country's next leadership. In 2010, there were conditions for resetting the legal framework for the media.

In 2011, the new Constitution of Hungary was adopted, which defined the basic principles of the media, and in 2010 – the Law governing the media and communication, which established the National Office of Mass Media and Communications. The law established the obligation of the press to provide reliable, prompt, accurate information to consumers on national and European public life, as well as on important events for Hungarians.

At the same time, these laws have led to full control of the Hungarian media by the government, which in turn undermines the democratic values and authority of the European Union. European governments and international organizations, Hungarian mass media oppose the introduction of total control of the media, but the authority keeps under its control domestic legislation in this area, as the media continue to determine the political life of the country and always clearly state their position on the ruling regime.
