Practical aspects of the implementation by the Constitutional Court of Ukraine of functional powers in the mechanism of state authority

Abstract

The article investigates the issue of practical reflection of the influence of the body of constitutional jurisdiction in Ukraine on the functioning of the state mechanism of power. The main functional aspects of the activity of the Constitutional Court of Ukraine and their reflection in its activity as the only body of constitutional jurisdiction in Ukraine are determined. It is established that the Constitutional Court of Ukraine plays a particularly important role in the process of interaction between different branches of government and certain higher state authorities. The practical experience of the Constitutional Court of Ukraine confirms the thesis that the statement that indicates the special status and importance of the body of constitutional jurisdiction to ensure the constitutional order and balance of the mechanism of checks and balances is justified. The exercise of constitutional control over the proper observance of the constitutionally established limits of activity by public authorities ensures the observance of the principles of a democratic and legal state. The practical aspects of the activity of the Constitutional Court of Ukraine, which reflect the implementation of certain functional powers that directly affect the mechanism of state power and interaction with higher state authorities, are analyzed.

The purpose of the article is to study the practical aspects of the Constitutional Court of Ukraine in the state mechanism of power.

The scientific novelty lies in the study and establishment of the mechanism of realization of functional powers of the Constitutional Court of Ukraine, as a body with a special status, in the mechanism of state power through the established practice of interaction with higher state authorities.

Conclusions. In the system of public authorities, the Constitutional Court of Ukraine (hereinafter - the CCU) has the opportunity to influence the functioning of the system of public authorities as a whole through the adoption of decisions that are binding. Due to the special place of the CCU in the system of public authorities and endowment with exclusive powers, its decisions can significantly bring significant transformations into the mechanism of public power and can be further used in the exercise of their powers by public authorities.

Due to a number of factors, including the low level of legal awareness and commitment to the basic principles of state power, public authorities in Ukraine tend to adopt regulations based solely on "political will", "political expediency". and other unconstitutional motives. Such motivation does not go unnoticed by the CCU when making certain decisions that have significant public or political interest. Attention should be paid to such risks, in particular, through the political principle of forming the CCU. Thus, the decisions taken by the CCU can be based both on the fundamental principles enshrined in the Constitution and on evaluative judgments and concepts that give room for "appropriate" in specific times of interpretation. In connection with the above, the main problem and probably the biggest threat to the CCU is its politicization as a state body and the politicization of its decisions, which, in fact, can make significant changes in socio-political life and the mechanism of state power.
