Constitutional control in mechanism of public governance

Abstract

The article explores the question of the use of the means of constitutional control in the process of functioning of the mechanisms of public administration in the current conditions of transformation of relations between public authorities in Ukraine. Particular attention is paid to identifying the place and role of constitutional control in the system of interactions between public authorities and the functioning of the political system of the state as a whole. It is determined that the Constitutional Court of Ukraine has special powers, which allow to regulate the process of relations between different branches of government and to balance the political system of the state. As a result of its activity, the basic principles of functioning of the mechanisms of public administration are ensured and conditions are created for ensuring the rights and freedoms of the individual and the citizen, the principle of separation of powers is ensured, and the contradictory contradictions between public authorities are eliminated. The importance and the possibility of applying the mandatory preliminary constitutional control in Ukraine as an important preventive measure in the conditions of a real possibility of abuse by some higher bodies of state power in the present conditions are analyzed.

The purpose of the article is to investigate constitutional control as the main activity of the Constitutional Court of Ukraine in the mechanisms of public administration.

The scientific novelty is to investigate and define the function of the constitutional control of the Constitutional Court of Ukraine as a deterrent in the mechanism of public administration, the widespread use of which makes it impossible to prevent or prevent the abuse and excess of powers in the exercise of public authority functions.

Conclusions. The progressive development of the state and the effectiveness of the mechanism of public administration are measured first of all by the coherence and uniqueness of the activity of the state authorities. Achieving a high level of efficiency of functioning of public administration mechanisms is possible in the absence of competition, interaction and ability to transform under the requirements of time of state institutions, which play a leading role in ensuring the activity of public administration mechanisms. The development of public administration mechanisms should take place using the tools of constitutional control as a means of eliminating mistakes, preventing possible and smoothing out the process of functional confrontation, which is detrimental and slows down the overall pace of state development. The use of prior and subsequent constitutional control allows to resolve conflict situations and prevent possible abuse, which will certainly affect the quality of implementation of public administration mechanisms. Decisions and conclusions adopted by the body of constitutional jurisdiction have unambiguous understanding and are of particular relevance to public authorities and citizens, as they possess the qualities and characteristics of acts enabling the effective exercise of their functions by public authorities. The application of the means of constitutional control makes it possible to objectively resolve the issues of unambiguous application and understanding by the state authorities of the basics laid down in the Constitution of Ukraine. At the same time, the study of the constitutional control of the mechanisms of public administration gives grounds to argue that the capacities of the body of constitutional jurisdiction in Ukraine are underutilized on the basis of its powers. The development and effective functioning of public administration mechanisms require further development, in particular with regard to the use of constitutional control. Such a thesis proceeds from the study of the practice of applying different types of constitutional control by bodies of constitutional jurisdiction in different states. This thesis is particularly relevant when state authorities demonstrate the low quality of management functions and the controversy of the decisions taken, which in some cases are purely political in nature. The functioning of the mechanisms of public administration in terms of political expediency poses a threat to statehood and creates the preconditions for the collapse of the administrative system due to the lack of constitutional coherence. The analysis of constitutional control makes it possible to conclude that this tool can be the most effective if it is obligatory applied to the decisions made by the higher bodies of state power. In this regard, the widespread use of constitutional control measures will help to strengthen the constitutionality and strengthen the governmental mechanism in the interests of the state's development and protection of citizens' rights.
