Improvement of the state mechanism of protection of human rights and citizens through the activity of the Constitutional Court of Ukraine

Abstract

The article deals with the problems of functioning of the state mechanism of protection of human rights and citizens at the present stage of development of the Constitutional Court of Ukraine. Attention is paid to approaches to understanding the mechanism of protection of human and citizen’s rights with the help of the Constitutional Court of Ukraine and analysis of the existing legislation on this issue. It is noted that the Constitutional Court of Ukraine plays a particularly important role in the functioning of the state mechanism for the protection of human rights and citizens. The result of its activities is not only the actual protection or restoration of human and citizen rights, but also the overall constitutional control over the proper observance of constitutionally established human and citizen rights by public authorities. The significance and possibility of applying the constitutional complaint in Ukraine as an element of the mechanism of protection of human rights and the citizen are analyzed.

The purpose of the article is to study the activities of the Constitutional Court of Ukraine in the state mechanism of protection of human and citizen’s rights and freedoms.

The scientific novelty lies in the study and determination of the Constitutional Court of Ukraine as a constituent mechanism of state power, whose main function is to ensure the observance and protection of constitutionally determined human and citizen rights.

Conclusions. The establishment of statehood and the effectiveness of the mechanism of state power are measured first of all by the state of observance and protection of human and citizen’s rights. The establishment of mechanisms for the protection of human rights at the highest state level should be carried out using the instruments of constitutional justice in accordance with the practice of constitutional effectiveness of public power, taking into account the principle of recognition of human being as the highest value, as well as the maximum observance of the Constitution by public authorities in the exercise of their powers in the respective territories. The issue of ensuring constitutional human and citizen rights must be a priority for all public authorities, and effective enforcement of their observance is possible only at the expense of the functioning of a responsible influential body - the body of constitutional justice. Decisions and conclusions adopted by the Constitutional Court of Ukraine are a guideline for state authorities and citizens, have exclusive legal force and are a measure of the real development of the state mechanism of protection of human rights and citizens. The presence of a constitutional justice body makes it possible to unambiguously and objectively resolve controversial situations arising from heterogeneous approaches and the understanding of the constitutional basis of human and citizen rights by public authorities. At the same time, the study of the state mechanism of protection of human rights and the citizen confirms the opinion that the possibilities of the Constitutional Court of Ukraine, based on its powers, are not used enough. The establishment of an effective state mechanism for the protection of human rights and citizens requires further development, in particular with regard to the application of the constitutional complaint institute. This is due to the low efficiency of the activity of the state authorities in the issues of protection of human rights and the citizenry with the use of constitutional justice and the inability to quickly solve problems and challenges of different nature. The analysis of human and citizen’s rights protection instruments makes it possible to conclude that the most effective are the instruments that enable an individual to independently exercise the protection of their rights by actively appealing to the competent authorities. In this regard, the introduction of a constitutional complaint institute will significantly strengthen the mechanism of protection of human and citizen’s rights and will provide the Constitutional Court of Ukraine with the possibility of ensuring the constitutionally established rights and freedoms of the individual and citizen.
