Peculiarities of the constitutional status of the President of Hungary

Abstract

The purpose of the article is to analyze the mechanisms of interaction between the President of Hungary and the Government and Parliament, which are enshrined in the Constitution of Hungary and other legal documents.

The scientific novelty is to determine the features of the constitutional status of the President of Hungary, his place and role in the system of state power, as well as to study the possibility of using positive experience for the development of Ukrainian statehood.

Сonclusions. The general principle of functioning of the Institute of the Presidency in the system of state power of the Republic of Hungary is that the Presidency is a neutral power outside of the three branches of government. The role of the President of Hungary as a political counterweight to the Government and Parliament is not to make the decisions, but to draw attention to the circumstances, and thus to oppose the branches of government.

The President has no power, according to the Constitution he expresses national unity and acts as watchdogs of the democratic functioning of the state apparatus. Performing the functions of «watchdog» and «national unity» requires the demonstration by the President of his subjective view.

The President of the Republic performs the integration function that gives the President a symbolic role in the implementation of the constitutional values. The Parliament is the body with the complete authority, which elects the President and forms the politically responsible Government. The decisive role of the Prime Minister in the block of legislative and executive power gives him the status of a public law person that constitutes the constitutional basis of the status mandate for determining the general direction of public policy within the government program.

The experience of Hungary is essential to maintenance and development of Ukraine as a parliamentary republic. The power-sharing system requires even greater attention of the Ukrainian authorities than in Hungary. If our neighbors are talking about the already established order in this area, then in Ukraine the processes of formation of constitutional state continue.
