Arbitration court as a subject of law implementation in the settlement of international commercial disputes

Abstract

The purpose of the article is to study the mechanism of establishing jurisdiction of the arbitral tribunal for the settlement of commercial disputes, to analyze the meaning and content of the concept of arbitrability.

The scientific novelty consists in the study of peculiarities of delegation to the international commercial arbitration of law implementation functions by state courts. Thus, it is argued that by delegating such functions, the state does not automatically exclude the specified categories of disputes from the jurisdiction of the courts. Only in the presence of a written arbitration agreement that will meet the requirements of validityand enforceability, compliance with the requirements of arbitrability of the dispute, as well as the realization of one of the parties intent to resolve the dispute in the order of arbitration by filing an arbitration claim (lawsuit) such dispute is excluded from the jurisdiction of the courts and is considered by arbitration.

Conclusions. Taking into account the contractual prerequisites for referral of a dispute to the decision of international commercial arbitration, arbitrability of disputes is really a criterion that defines the scope of the partiesto the dispute legal capacity regarding the choice and transfer to arbitration of certain, defined categories of disputes (defines the limits of contractual freedom of the parties), and on the other hand, at the stage of the dispute, the arbitration panel is able to identify the relevance of the particular dispute to those that may be resolved by the arbitration, thus delimiting the scope of the jurisdiction of the state courts.

The provisions of the analyzed legal norms indicate that at the level of the Ukrainian legislation an appropriate mechanism for the implementation of the provisions of the New York Convention of 1958 was created, and participants who have concluded an agreement on the transfer of a dispute to a decision of international commercial arbitration really have the right to use this method of alternative settlement of the dispute with its simultaneous exclusion from the jurisdiction of the state courts, which is provided by the provisions of the codes of procedure on leaving the claim without consideration and closing the proceedings.
