Administrative responsibility for violations of the environmental legislation of the Republic of Belarus

Abstract

The purpose of the article is to research the norms of administrative responsibility for violations of the environmental legislation of the Republic of Belarus.

Scientific novelty. The content of environmental articles of the Code of the Republic of Belarus on administrative offenses, which were systematized and divided into eight groups, is considered. It is shown that there is a detailed regulation of administrative liability in this area and the use of higher penalties in comparison with the Code of the Ukraine on administrative offenses. There is a link between the rules of administrative responsibility and the provisions of the Statute of the Grand Duchy of Lithuania, which also regulated the responsibility for the destruction of animals, birds, plants, certain types of trees and the burning of natural objects. The connection of the norms of administrative responsibility in the Belarusian legislation with the Soviet environmental legislation, which regulated the penalties for offenses against animals, land, subsoil and other natural objects, was researched.

Conclusions.

  1. The systematization of offenses regulated by the Code of the Republic of Belarus on administrative offenses, allowed them to be divided into eight groups, based on the object-oriented approach, which allowed using calculations to determine the availability of the largest volume of material - 29.4% - in articles devoted to the protection of the animal world.
  2. The presence of continuity tendencies of the administrative responsibility rules in the legislation of Republic of Belarus for violations in the field of natural objects with the Statutes of the Grand Duchy of Lithuania and Soviet legislation is shown.
  3. A comparative analyze of the environmental norms in the codified acts of the Republic of Belarus and Ukraine testifies to the application of more significant penalties in the Republic of Belarus compared to Ukrainian norms.
