Pefcefulness as a mandatory identificanion of the right to freedom of the assemblies

Abstract

The purpose of this article is to study the content of the concept of «peacefulness», its components, as a compulsory sign of the right to freedom of peaceful assembly.

Scientific novelty. The article outlines the linguistic, legal, and literary understanding of the concept of «peace», «peacefulness», which provides a comprehensive, objective understanding of the concept and qualitative use of these concepts in the legal Nata. In the domestic legal science there are no scientific studies of the signs of the right to freedom of peaceful assembly, namely, the key feature – peacefulness, which generates a gap in theoretical science, which affects the practice of applying the rules of positive law. As a result, the theoretical and methodological concept of «peacefulness» was made, which eliminates the existing gap in the law. For civil society and a democratic state, maintaining peace and security during peaceful gatherings is extremely important.

Conclusions. Peace as a sign of the right to freedom of peaceful assembly should include a peaceful purpose, respect for the person, his honor and dignity, rights, freedoms and interests, respect for the social order, constitutional order, observance of the principles of the rule of law and law, the absence of weapons, military Uniformity, lack of means of concealment of individuality (masks), lack of calls for violence, overthrow of power in an unconstitutional way. Our signals are key to influencing the state of law and order in society, as well as to ensure the rights, freedoms and interests of man and citizen as organizer and participant in such assemblies, as well as outsiders who have no relation to such a meeting, including those who do not share the views of the organizers and participants in peaceful gatherings that exercise their right to peaceful assembly. Peace, as a sign, guarantees the possibility of a compromise by means of mutual concessions of the subjects of the exercise of the right to peaceful assembly and supporters of other views.
